'Misunderstanding' turns violent in Dugger shooting case

Gunshots ringing through the air, wounding two people and striking the windshield of a passing truck during the early morning hours Sunday, apparently were the result of a domestic dispute -- a misunderstanding -- that turned violent. Timothy Kean, 35, of rural Sullivan, has been charged with three counts of attempted murder -- all class A felonies. The most seriously wounded victim, 39-year-old Patrick Ruff, of Jasonville, remains a patient in the intensive care unit at IU Health Methodist Hospital in Indianapolis. He's in a coma and is unresponsive after sustaining the blast from a shotgun to the head and shoulder, according to a family member, Darla Jenkins of Dugger. His condition was termed critical by Jenkins on Tuesday morning. "He is not stable. He's critical. It's a waiting game now," she told the Greene County Daily World on Tuesday morning. "We have no idea why this all happened. I hope everyone will keep him (Ruff) in their prayers." A probable cause affidavit filed by Indiana State Police Det. T.C. Hanks does shed some light on the circumstances that led to the gunshots and mayhem that followed. The shooting happened in a gravel parking lot south of Main Street and east of Second Street -- next to the Uptown Tavern in Dugger. A male witness told police that he was walking out of the bar about 3:30 a.m. and heard a loud bang. He then heard a second shot and saw James Gardner's truck windshield getting shot as he was driving down the street, according to the affidavit. Gardner immediately jumped out of his truck and confronted the shooter -- Kean. The male witness told police that Kean "raised the gun at Gardner, but the gun didn't do anything. Either because of malfunction or the shell not being ejected." The male witness said Kean then left in his truck with Gardner following him in his truck. The two allegedly got into a fight at a residence located at 1024 South County Road 600E. Hanks wrote in the affidavit that the male witness said, "Gardner was just in the wrong place at the wrong time, but feels Tim (Kean) would have shot James (Gardner) too if the gun would have fired." The male witness also told police that after the two drove away, he went to Ruff's truck and saw he had sustained a shotgun wound to the head. He described the gun as a single shot shotgun. Wilson told investigators that he did not see Lovelace get shot, but he said she "dates" Kean's brother, Andy. The witness said that Andy Kean was arrested earlier in the evening on an OVWI charge and was in jail. Another witness, a female, told ISP investigators there may have been a perception that something was going on between Ruff and Lovelace. "She thinks maybe there was some jealously with Tim thinking LeighAnn was cheating on his brother with Ruff," Hanks wrote in the probable cause affidavit. Sullivan County Sheriff Brian Kinnett was able to secure a video surveillance tape of the crime scene near the bar from the owner of Northside Machine Shop, located at 8068 N. Main Street. Lovelace, who was hysterical at the hospital because of what happened, told ISP Det. Harris Smith at the hospital that she didn't know why Kean opened gunfire. Calling the incident "senseless," she stated, "Tim shot Ruff in the back of the head and then she saw Tim with the gun and she started running back toward the bar and Tim shot her. She described Ruff as a family friend and had no idea why Tim was shooting," Hanks wrote in the probable cause affidavit. Police interviewed Kean and he said he had gone to the Uptown earlier in the evening after he found out his brother had been arrested for OVWI. He was in jail and needed to be bonded out. The suspect said he became upset when he saw Ruff driving his brother's truck with Lovelace as the passenger as he drove past the bar. Kean said Lovelace was supposed to be on what he told police was a "girl's night out." Kean told police that he went back home and got a shotgun and returned to the bar with the intentions to shoot Ruff, whom he thought was "messing around" with his brother's girlfriend, according to court records. Kean told police that if Ruff would not have been getting into the truck, he would have waited in the parking lot for him. "He admitted shooting Ruff one time, but does not remember shooting LeighAnn or Gardner's pickup. He does remember getting chased and beat up," Hanks wrote in the probable cause affidavit. "Kean finished up (the interview) by advising that he grabbed his gun and went to the Uptown with intent to shoot Pat Ruff and he was so enraged at the sight of Ruff driving his brother's new pickup with LeighAnn that he wanted him (Ruff) to die."
