Goose Pond shooter indicted by federal grand jury on gun charge

The Linton man, who allegedly fired a .20 gauge shotgun and struck a kayaker at the Goose Pond Fish and Wildlife Area south of Linton in July, now faces a federal firearm charge. Brandon Criss, 25, a former Bloomfield resident now living in Linton's Independence Place, was indicted Wednesday by a federal grand jury in Indianapolis and charged with unlawful possession of a firearm by a convicted felon. The indictment came following an investigation by the Bureau of Alcohol Firearms and Explosives, the Greene County Sheriff's Department, and the Indiana Department of Natural Resources. U.S. Attorney for the Southern District of Indiana Joseph Hogsett came to Linton on Wednesday afternoon to announce Criss' indictment. Hogsett said Criss is a convicted felon -- making it unlawful for him to possess any kind of firearm under federal law. Criss was convicted Feb. 9, 2009 on one count of intimidation and one count of battery on a law enforcement officer resulting in bodily injury. He was sentenced to two years in prison. Hogsett said Criss now faces a maximum sentence of 10 years in federal prison and a $250,000 fine if convicted. Criss is scheduled to immediately be transferred from the Greene County Jail in Bloomfield to Marion County Jail in Indianapolis where he will be held in pre-trial detention without bond until he is called for an initial hearing before U.S. Magistrate Craig McKee. The shooting victim, Stephen Moberly, 63, sustained minor head injuries July 14 after being struck by shotgun pellets that police allege Criss fired at him. Investigators say Criss apparently approached Moberly while he was loading up a kayak after time spent boating in the state-owned marsh area. According a police report, the pair "exchanged pleasantries." Moments later, Moberly was struck in the head by shotgun pellets that Criss allegedly fired while standing near State Road 59. Moberly drove himself to the Linton Police Department following the 3 p.m. incident, and was treated and released from Greene County General Hospital in Linton. Criss was apprehended soon after the incident after riding away on a bicycle that authorities say was stolen. "At the time of his arrest, Criss appeared to be under the influence of an unknown controlled substance. At the jail, Criss admitted he had shot the gun at Goose Pond FWA, but claimed he did not realize there were patrons in the parking lot," Hogsett stated. The suspect was taken to Greene County General Hospital for a mental health evaluation, then transported to the Greene County Jail in Bloomfield. A New England Firearms .20-gauge sawed-off shotgun was recovered from a backpack in a nearby field, where it had allegedly been tossed by Criss. "Somebody saw him throw the backpack so he tried to get rid of the evidence, but they (authorities) recovered it. My sense is we have got a very good, clear and convincing case that he's a felon in possession of a firearm," Hogsett explained. "Inspection of the shotgun from Criss' backpack revealed the barrel of the weapon has been cut down to approximately 11 1/2 inches -- making it a 'sawed-off' or 'short-barreled' shotgun under federal law. Possession of such a weapon requires a special registration, which Criss does not have." The U.S. Attorney said the charges against Criss are his effort to follow through on a promise he made in a June visit to Linton that violent repeat offenders in Greene County will face stiffer federal prison sentences, if they continue their illegal activities. "This is not something that will be pled down," Hogsett stated in reference to the charges against Criss. "The reason people don't want to see me (as a federal prosecutor) is they know I am not the least bit interested in making their life any easier." Hogsett said he hopes this particular case sends a clear message to law-abiding citizens and criminals alike. "In this particular instance, I think if you check with the police and the sheriff's department, I think they will tell you that prosecuting Mr. Criss under federal jurisdiction is a good thing," Hogsett stressed. "Hopefully if you can get Brandon Criss off of the streets -- if he is guilty and if he is convicted -- of Linton and Greene County and keep him out of the Goose Pond area with a sawed-off shotgun, then all that means is that the police department and the sheriff's department are going to be able to allocate their resources in a way that makes it more efficient and more effective because they are not chasing Brandon Criss anymore. There might be a couple more Brandon Crisses out there. But I'm telling them if they continue to misbehave then their fate is going to be the same as Mr. Criss. They are going to come face to face with a federal prosecutor and run the risk of doing federal time and that's not in their best interest." Hogsett said pending charges filed in July in Greene Superior Court will likely be dismissed in favor of more stringent federal sentencing guidelines that require those convicted to serve at least 85 percent of the their sentence time. Conviction of state filed charges nets a defendant two days credit for each served in most instances. Locally, Criss is charged with criminal recklessness with a deadly weapon, a class D felony; possession of a sawed-off shotgun, a class D felony; theft, a D felony; and possession of marijuana, a class A misdemeanor. Criss also has pending a misdemeanor case in Superior Court -- filed June 20 -- charging him with public intoxication and resisting law enforcement.
